Medicare Set-Aside Trust Services
A special needs trust may not be adequate if your client is receiving Medicare benefits. Your client may need to create a Medicare Set-Aside Trust to reimburse the government for future medical expenses related to the injury or disability. Price and Price has experience assisting clients in this complicated and constantly changing area of the law.
While Medicare Set-Asides have been used for years in workers' compensation cases, only recently has the government added set-aside requirements for personal injury victims.
Currently, the government requires Medicare recipients to create a Medicare Set-Aside if they have settled a claim for more than $25,000. A Medicare Set-Aside also is mandatory if a victim settles a case for more than $250,000 and expects to be eligible for Medicare up to 30 months after the settlement.
